Game description

The Fintensy Fraud Challenge Game (the “Game”) requires the Player to analyse fictitious documents in order to assess whether or not these documents seem forged.

This promotional Game is purely recreational. Participation is free of charge, which means that no compensation, of any kind, will be requested from the Players and that participation to the Game does not entitle any Player to any prize, reward, benefit or other advantage of any kind.

Access to the Game

The Game is publicly available on the website of Fintensy. It is however solely intended for individuals of at least 18 years of age and with legal capacity, as well as validly-represented legal persons, established within the European Union.

Participation to the Game does not require any account creation from the Player.

Participation in the Game constitutes full acceptance of these Terms of Use.

Game play

The goal of the Game is to determine whether fictitious supporting documents (such as identity cards or payslips) are genuine or forged. A document is presented to the Player. The Player is given some time to analyse this document and must then indicate if this document seems to be genuine or forged. A total of ten documents is presented to the Player. Each correct answer is worth one point. No points are awarded in case of wrong answer. The final result is disclosed to the Player after they has reviewed all the documents. The Player is free to stop the Game at any time.

Availability of the Game

The Game is any time available on the website of Fintensy. Fintensy however reserves the right, at any time and without prior notice, to:

  1. modify or update the Game,
  2. carry out maintenance operations affecting the Game,
  3. temporarily suspend access to the Game, in particular for maintenance or technical reasons, and
  4. permanently discontinue the Game.

Fintensy shall not be held liable and bear any cost for any unavailability of the Game resulting from such maintenance, suspension, modification or discontinuation.

Prohibited used and abusive behaviours

Players must use the Game in a fair and lawful manner. Players are prohibited, among other things, from:

  • Attempting to circumvent, manipulate or otherwise interfere with the Game’s mechanisms or rules;
  • Using bots, scripts, automated tools or other means to interact with the Game;
  • Attempting to disrupt, damage or interfere with the operation or availability of the Game or the Website;
  • Exploiting or attempting to exploit bugs, vulnerabilities or other technical flaws in the Game or the Website; and
  • Using the Game for fraudulent, unlawful or otherwise abusive purposes.

The supporting documents used in the Game are fictitious documents specifically created by Fintensy for this purpose. They are therefore intended solely to serve as materials for the Game and may under no circumstances be used for any other purpose. Such documents may accordingly not, among other things, be recorded, copied, reproduced, modified, altered or reused for any other purpose.

Fintensy reserves the right to take any appropriate measures in response to prohibited or abusive behaviour, including restricting or suspending access to the Game.

Intellectual property rights

The Game and all its elements, including its code, graphics, text, logos and sounds are protected under applicable copyrights, trademark rights, and/or any other intellectual property rights. None of these rights are transferred to the Players. These elements are therefore solely disclosed in the context and for the purpose of the Game. No other use such as, without limitation, amending, copying, duplicating or redistributing is permitted without the prior written consent of Fintensy.

Personal Data

The proper conduct of the Game involve the processing of personal data. Such data is processed in accordance with this Privacy Clause.

Your personal data is processed by and under the responsibility of Fintensy SA/NV, a Belgian company registered under BCE number 0651.648.473, whose office is located at 1 Chemin du Stocquoy, 1300 Wavre, Belgium, in compliance with this privacy clause and respecting the applicable legislation, in particular, the General Data Protection Regulation (GDPR) 2016/679.

Purposes of processing

  • Participation in the Game: your personal data will be collected and processed solely for the purpose of enabling your participation in the Fintensy Fraud Challenge Game. This includes but is not limited to: (i) enabling your participation in the Game, (ii) ensuring a proper game play (including its technical aspects) and (iii) handling any requests, questions or complaints that may arise in connection with the Game.
  • Functioning, development and improvement of the Game: we can process some of your data, either in an automated or manual way, with the aim of ensuring the smooth functioning of the Game and its ongoing development and improvement.
  • Prevention of prohibited used and abusive behaviours: we can use some of your personal data to take the necessary measures to prevent prohibited used and abusive behaviours (see above).
  • Direct Marketing: with your prior consent, we can use some of your data to send you marketing communications on behalf of Fintensy. This can for instance include the sending of news about Fintensy or interesting offers proposed by Fintensy.

Legal basis for processing

  • Participation in the Game: your personal data will be collected and processed on the basis of their (pre-)contractual necessity. The processing activities involved are indeed necessary for the proper conduct the Game as well as for the correct handling of Players’ potential questions, objections and reclamations.
  • Functioning, development and improvement of the Game: your personal data will be collected and processed on the basis of the legitimate interest of Fintensy to maintain and develop high-quality services.
  • Prevention of prohibited used and abusive behaviours: your personal data will be collected and processed on the basis of the legitimate interest of Fintensy to prevent prohibited used and abusive behaviours.
  • Direct Marketing: your personal data will solely be collected and processed on the basis of your prior consent.

Data collected and processed

  • Participation in the Game: the categories of data that we may collect and process in this context include your electronic identification data and any data you proactively provide us with (e.g. in a request, question or complaint).
  • Prevention of prohibited used and abusive behaviours: the categories of data that we may collect and process in this context include your electronic identification data.
  • Direct Marketing: the categories of data that we may collect and process in this context include your identification details (e.g. full name), contact details (e.g. e-mail address) and company identification details.

Data sent to and processed by third parties

Some of your data may be transmitted to – and processed by – Fintensy’s technical partners (only acting on behalf of Fintensy). We may also transfer all or part of your data to third parties, when that is imposed on us by an administrative or a judicial authority, in compliance with the relevant legislation. Your data will however not be transferred to any third country or international organisation.

Automated decisions

The collection and processing of your personal data in this context will not result in any automated decisions (including profiling) affecting you.

Duration of data retention

The personal data collected and processed will solely be retained for a defined period that will never exceed the necessary processing period for which they have been collected. This retention period may, however, be shortened if you exercise your right to erasure. We ensure the security and confidentiality of your information throughout the entire retention period.

Data subject’s rights

In the context of the processing of your personal data, you have the right to access, rectify and erase your personal data as well as to restrict – and object to, where applicable – the processing of your personal data. You also have the right to data portability as well as, when your personal data is collected and processed on the basis of your prior consent, the right to withdraw, at any time, your consent to the uses that you have previously authorised. Please however note that the withdrawal of your consent for a specific processing will not affect the processing already carried out. Applicable law and competent jurisdiction

Without prejudice to the applicable mandatory provisions, these rules are governed by Belgian law and any dispute arising out of or in connection with these rules shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.

Modification of these Conditions of use

Fintensy reserves the right to modify these Conditions of use at any time. The Conditions of use applicable are the Conditions the Player accepts before each game.
